Wonderfully stupid legislation, Canada.

Particularly since recent studies show that hands-free devices give very little benefit in preventing crashes. Hopefully this doesn't migrate down here.

No doubt my opinion will be unpopular, but I've often wondered why hams and CBers should be exempted from distracted driver laws. Distraction is distraction whether one is using a cell phone, a radio, or eating a cheeseburger while driving.

Yep, sure destroys my enthusiasm for operating mobile. This is another one of those laws that were to protect the stupid, but affects everyone. We have a law against speeding, but that hasn't stopped speeding. We have a law against drinking and driving but that doesn't stop people driving drunk [DUI]. Just another law that some people will feel they have to break.

It rated a quick blurb on the news here, talking to psssengers can be just as distracting as talking on a cellphone.

Maybe passengers should be banned, radios, CD players, or anything that doesn't have a direct bearing on the safe operation of a vehicle.

Ah, too bad police and fire departments wont be able to use their radios anymore. I use radios in my job also, guess I will have to not answer my radio.

Actually there are many states that have laws on the books to exlcude radio. I read it recently somewhere.

Here is the link to the statute, I was unable to find anything indicating that hams were to pull off the road to communicate...with anyone.

Apparently even this law says you can use a mobile radio if it is MOUNTED:

Exemption for pressing buttons

14. (1) A person may drive a motor vehicle on a highway while pressing a button on a hand-held wireless communication device to make, answer or end a cell phone call or to transmit or receive voice communication on a two-way radio if the device is placed securely in or mounted to the motor vehicle so that it does not move while the vehicle is in motion and the driver can see it at a quick glance and easily reach it without adjusting his or her driving position.

This headline is complete bunk. Following are the related excerpts of Bill 118.

Time-limited exemption for amateur radio operators

13. (1) Until January 1, 2013, drivers who hold a valid radio operator certificate issued under the Radiocommunication Act (Canada) may drive a motor vehicle on a highway while holding or using a two-way radio.

AND

14. (1) A person may drive a motor vehicle on a highway while pressing a button on a hand-held wireless communication device to make, answer or end a cell phone call or to transmit or receive voice communication on a two-way radio if the device is placed securely in or mounted to the motor vehicle so that it does not move while the vehicle is in motion and the driver can see it at a quick glance and easily reach it without adjusting his or her driving position.

(2) A person may drive a motor vehicle on a highway while pressing a button on a device that is worn on his or her head or hung over or placed inside his or her ear or is attached to his or her clothing and is linked to a hand-held wireless communication device to make, answer or end a cell phone call or to transmit or receive voice communication on a two-way radio or a hand microphone or portable radio.

Sounds as dumb and poorly written as the law here in the People's Republik of Kalifornia. Then add all the creative interpretations by various law enforcement agencies and it becomes a real zoo. IMHO, holding a cell phone to an ear really is a lot worse than holding a mic or HT. I naturally tend to restrict my head motion more when holding a cell phone. Even so, what is the real issue? If I cannot control my vehicle safely I deserve a ticket- radio or no radio. More laws fixes nothing. More laws only make lawmakers feel important. Time to fire a bunch of politicians and make their replacement restricted to a part time schedule!

You receive a hardy amen to that Stu! Kick 'em out in 2010! As I remember George Deukmejian once said about the number of new laws in California "8000 laws is TOO MANY" ...and that was just 1 year

Using two way radios in vehicles are as distracting as cell phones. I no longer operate a mobile station.

This Canadian law is the result of living in a socialist democracy where the government, absent of any supportive data, decides what is best for the community as a whole.
Have you ever noticed that "community" and "communism" start out being spelled the same way? It is like that in real life as well.

For those that think this law is a good idea to impose on others, remember that we live in a "republic," not a democracy (thank goodness), where the rights of the individual still trump the will of the majority. Sheep think it is a good idea to flock together for safety, all the way up to the slaughter house!

If we are going to pass laws like this to make us safer, how about an age restriction on driving? No one under 25 or over 70 will be issued a driver's license!
