MICHIGAN HAM TO YIELD LICENSE UNTIL 2004 IN EXAM CASE

The FCC has cut a deal with former ARRL-VEC Volunteer Examiner Andrew Penn, N8JVA, whose license was designated for a revocation hearing in the wake of 1997 examination irregularities in Michigan. A February 7 letter to Penn, from FCC Special Counsel for Amateur Radio Enforcement Riley Hollingsworth, affirms the terms of the voluntary agreement.  Penn must surrender his Amateur Extra class license for three years, ten months in lieu of facing a license revocation hearing.

The FCC action stemmed from a June 3, 1997, Oak Park, Michigan, examination session.  Penn was a VE and submitted the paperwork for applicants, one of them Penn's son. As a result of an FCC investigation, the FCC downgraded the license class of two applicants and canceled the license of Penn's son, Steven A. Penn, formerly KC8HUM. FCC evidence indicated that Andrew Penn added paperwork to the exam session package for applicants who did not pass the required examination elements at the Oak Park session. Evidence also indicated that Andrew Penn applied the signatures of three other VEs to the application papers  without their knowledge.

The FCC says that three of the examiners knew nothing of the scheme. The other three VEs brought the situation to the attention of the ARRL-VEC and the FCC.

The FCC agreement calls for Andrew Penn to turn in his license by April 20, 2000. He will be allowed to request renewal of his license on February 21, 2004, the day before his current license term ends.

The FCC should take his license for good! I would like to see the good old days return when the FCC held the exams. I think the whole situation is going to get worse with the new de-regulation. I wonder how long before it becomes like CB?

I think his license should have been suspended forever. This sends a message that the worst that will happen to a cheat is "maybe" have the license suspended for a few years. These kinds of situations really put a blot on the "self policing" reputation of hams. It is hard to believe anyone would stoop so low as to "rig" an exam, especially for a relative.

He should of lost his license for good! What he did wasn't just a little slip, he worked hard to cheat for his son. He should pay the price and not be let back in. As a VEC myself, I feel his actions have cost the rest of us some of our creditably.

I would say Mr.Penn was lucky it wasn't a whole lot worse. I wonder if it was worth losing his ticket for 4 years, and some friends just to get something for his son that he could have earned on his own?

It is unfortunate to hear aobut all the irregularities in the VEC system recently. This situation although a change in penalty will send a tough message to others that the Part 97 Rules to be followed to the letter or tough consequences will result.

N8JVA passed away one week after his licensed were suspended.......I wish we could all let him rest in peace.....There was another side to this story,that the FCC never published,which I will not go into,since Andy Is a silet Key....Thanks for reading this..Don..w8ns

This is N8KBA, widow of N8JVA and yes there was another side of this story that was never told.
Andy loved being a ham radio operator and never
did anything to dishonor his title. Please let
him rest in peace........

I wonder more about this "other side of the story" of N8JVA. I have no choice but to believe his widow. Riley Hollingsworth has a notoriously long known reputation for grandstanding in his own interest as well as for backing down from well heeled articulate people who have the gumption to formally contest him in court. I know of no instance where he has ever done anything for anyone but himself. He is an officious martinet and petty bureaucrat who possesses neither courage nor common decency.

I pray that his widow will see fit to come forward and tell the "true side of his story". If she wishes, I will certainly help. May God rest his soul and give him eternal peace.
