There are two reasons i think he deserves the fine ....

He knew that it was transmitting above the limit for exemption on that band. (why he even bothered to add a station call sign is beyond me)

Not allowing the FCC in apon positive identification -- is just the same as telling the police to go away when they show up yelling "Police - search warrant"

I have FM stereo transmitter that i have used in the past while at work .... I knew its power out put was below the level where you needed to notify the FCC.

The commercial FM band is just that -- Commercial, not a ham band.
