FCC Extends Reply Comment Deadline in BPL Proceeding:

The FCC has extended to June 22 the deadline to file reply comments (comments on filed comments) in its broadband over power line (BPL) Notice of Proposed Rule Making (NPRM), ET Docket 04-37. The FCC acted this week on a request from the National Antenna Consortium and the Amherst Alliance (NAC/Amherst) for a much longer filing deadline extension. The organizations said the June 1 reply comment deadline would not allow stakeholders adequate time to prepare comments that address the full two-part National Telecommunications and Information Administration (NTIA) BPL study. The FCC said the NTIA has indicated it soon will submit comments and a technical appendix that will include key findings of the Phase 2 report, which is due for release later this year.

"We believe that three weeks should provide ample time for review and analysis of this information, and accordingly grant the extension for that period," said FCC Office of Engineering and Technology Chief Edmond J. Thomas, who signed the May 26 Order Granting Extension of Time. NAC/Amherst had sought to have the FCC postpone the filing comment deadline until either September 1 or two months after the public release of the NTIA's Phase 2 study--whichever came later.

Noting that its Part 15 rules already permit Access BPL systems and that its February BPL NPRM places additional requirements on BPL systems over and above current Part 15 requirements, the FCC asserted that any further delay would diminish the Commission's ability to protect licensed users now occupying the HF spectrum. A further extension, the FCC added, also would "needlessly increase regulatory uncertainty" about BPL.

The FCC turned down a request that it reissue in substantially greater detail the provisions of its proposed BPL rules concerning interference prevention and mitigation and the enforcement of standards.

The FCC does not routinely grant such time extensions, and it denied earlier petitions, including filings from the ARRL and NAC/Amherst, to extend the initial May 3 comment filing deadline. The League and others had said commenters needed more time to digest the NTIA's Part 1 BPL study, released April 27.

People We all agree that BPL is a total waste and will interfere with all frequencies from DC to whatever the highest freq. it will be a pandoras box waiting to happen, also the Society of Broadcast Engineers are also aware of this as well.

Just hope the FCC will not sway to BPL and can the issue.

This is a good thing. I just informally wrote the chairman and suggested that the vast unused UHF TV spectrum could provide a far more appropriate broadband internet solution to rural areas than the expensive and limited BPL scheme that would pollute our "magical" HF frequencies. Unfortunately, despite 30 years of struggling with interference issues in the telecommunications industry, I have no clue how to make a proper formal comment to the FCC, and I needed more time to find out how.

I am not even a ham, yet. I let my license expire a decade ago, but was planning to help my daughter get on the air for some QRP HF CW DX enjoyment like I used to have when I was a kid. BPL will make that harder, and less-enjoyable than it should be. I'm sure you active hams are at least as concerned about this as I am, and I hope that you make the FCC aware of your concerns.

OK, the last day shown in the FCC document database is June 1, and I filed my comment today (June 2). FYI, on June 1, there were 20 comments, all against BPL. 2 comments were from shortwave enthusiasts, 1 comment was from a PHd in physics (who was concerned about the effect of HF spectral noise on superconducting power lines ???), and the rest were either from amateur radio operators, or from an unidentified source.

Twenty comments a day are not enough. Please get the word out to your friends. I am planning to "recruit" some of my co-workers. We probably need several hundred a day to make a dent. Time is short!

The FCC extended the Reply Comment period to June 22.

OK, I see how it works now. Comments are continually being added to the database on about a 24 hour delay. The society of Broadcast Engineers just posted a very interesting comment at:

I find it interesting that they refer to and rely upon the comments and engineering analysis of the ARRL. Kudos to the ARRL. I will get my own membership as soon as I get my ham ticket again. (Which should happen in 10 days.)

Just because some commentors like N3NL have very professional comments shouldn't dissuade anyone from making their own comments. A simple "BPL will be bad if it noises up the HF spectrum" type of posting would be fine. It only takes a few moments and it is gratifying to at least have done *something*.

I filed my second set of reply comments today. The OET of the FCC and NTIA have filed their comments. This just about closes the case on this subject.

What I have observed in this proceeding is that this is definitely a political put up job. The Commission is not interested in the numerous technical comments that have been filed by qualified professionals including those of NTIA. They are only interest in hearing others cheering on this poorly engineered system because someone with money wants it to happen.

The Commission might as well have issued regulations for this service under its own motion for all the good all the comments will do.

In my second reply comments, I pointed out the Commission needs to implement regulations that specify what harmful interference is, how long BPL providers have to respond to complaints, and how they should respond. In addition, I proposed that stiff penalties should be imposed for ignoring complaints from licensed services. Will this help? I think not, but I can not help but participate no matter the outcome. I would not feel good about myself as a citizen if I had chosen not to participate.

I do not feel that single page comments indicating opposition are a good thing. This is not about numbers like in an election. The ARRL pointed out that good well presented comments pointing out the problems and proposing solutions are the only real comments that need to be filed.

I have already said that this is a political exercise rather than a regulatory exercise. The White House has decreed this to be policy and that regulations must be enacted to make it happen. It would not surprise me that further regulations are just handed down on motion of the Commission in this matter since all the comments are in on this subject and there really is not much to add.
