Ok I installed windows 7 over vista on my laptop. While installing the program said it would make a "windows.old" file, and put the vista files in it. Everything installed ok poked around the old file, and there is nothing I need in it. My question is can these file be deleted w/o any problems?

Yes,  unless you want to be able to roll back upgrade. Unless you are really tight for HD space I would leave it be. What I normally do when upgrading the OS on a older computer is I install a new bigger and faster HD with old install cloned to it and then upgrade. This gives you a newer faster HD that boots quicker and a fall back if upgrade goes terribly wrong. HD's have come a long way in last few years and are much faster today.
