A seller may sell legal ham gear to anyone he chooses.

Yes, but I personally will not sell anything capable of transmitting to a non-ham unless it is a family member of a ham buying it for a gift to the ham.

It is legal to sell ham gear to an unlicensed person. It is legal for an unlicensed person to purchase and own ham equipment. The only thing that is not legal is for an unlicensed person to transmit with the ham gear.

It is not unusual for a person studying for a ham license to purchase a transceiver so that he can use it to receive until he gets the license.

Personally, I would make sure that the purchaser is aware of the license requirement prior to selling the equipment. I wouldn't sell it to someone who I knew was planning to use it illegally.

Some retailers have been making loads of money for years selling 10 meter radios (with CB channels built in) to freebanders and CB skip shooters.  They are still doing business at truck stops and over the internet as we speak!  They get around it by stating that the radio is "for export only"!  I wonder how many US CBers actually buy them (along with the 11 meter linears they also sell for "export") just so they can ship them overseas?

There are plenty of people who are just listeners and they aren't licensed.
