The FCC can't touch these guys selling from China who misrepresent their HT's
The eBay ad indicates that the unit "ships directly from California, USA" and that the seller provides "free domestic shipping." That puts at least someone
here in the States within the FCC's sights.
Technically, it's illegal to own one of these puppies, but with the internet it's a fool's errand to try to shut down these guys. Buyer beware. Know where you can legally send a signal. It's up to you as a licensed ham to know the rules.
I'm not so sure that it's even technically
illegal to simply own or posess one of these, provided you're a licensed ham. Misuse of this or any radio (out-of-band transmitting, for instance), or use of it when it exceeds allowable signal purity limits, can get one in trouble. Importing or offering such a transceiver for sale within the FCC's jurisdiction, however, is quite obviously against the law.
