I'd like input on the following senario:
Podunk decides to have a special day to honor something which includes a festival. Amateur radio group is invited. Podunk association indicates that after all vendor entry fees (amateur radio has to pay too) and admission fees are gathered, the association will do a profit sharing among all entries, including amateur radio.
FCC says we have to do the amateur bit for free. Is the profit sharing "being paid for services" or a donation?
Legal or not for amateur radio?

Instead of "profit-sharing" why not explain to the event organizers the concern and just have them make a "donation" rather than a "profit-sharing" payment to your local radio club. Or, you might set up your operation just outside of the event perimeter so that your activity could be accessed by the public without them having to pay an admission fee. Technically a touchy deal eh?

Well How about....
Cutting a deal with the festival managers to make your entry fee a percentage of the up front sales--whatever they may be.
That way you get to keep free and clear of active interacting participant and be there as an independant out of the profit shareing loop.
The only deal killer would be the uncertainty of specific receipts to the festival management.
