I was wondering if it was legal for my EchoLink node on 146.5800 simplex to transmit local weather alerts and for it to announce nets, club meetings and such. I have done a little research and from what I can find it is fine, but the trouble comes in, is it broadcasting? I was asked this by a fellow ham in the area that was wondering and I really hadn't thought about it.

I say it is fine due to part 97.111 B number 6, which states, "Transmissions necessary to disseminate information bulletins". To me an Information Bulletin would be announcements of meetings and might include weather alerts.

I also think it is fine due to part 97.113 Which in one part says, "(e) No station shall retransmit programs or signals emanating from any type of radio station other than an amateur station, except propagation and weather forecast information intended for use by the general public and originated from United States Government stations, and communications, including incidental music, originating on United States Government frequencies between a manned spacecraft and its associated Earth stations. Prior approval for manned spacecraft communications retransmissions must be obtained from the National Aeronautics and Space Administration. Such retransmissions must be for the exclusive use of amateur radio operators. Propagation, weather forecasts, and manned spacecraft communications retransmissions may not be conducted on a regular basis, but only occasionally, as an incident of normal amateur radio communications."

I am referring to the part that says, "...except propagation and weather forecast information intended for use by the general public and originated from United States Government stations..."

Can anyone clarify these conclusions?

Dear Timmy, (my son watches NickToons)

I'll bite, even though you didn't sign in with a callsign.

The main problem that I find with what you want to do is, as I understand it, you want to <i>pre-record</i> these messages and then <i> re-transmit</i> them over amateur radio frequencies. Your argument using the FCC regulations may fall on deaf ears, especially because the only time you may use pre-recorded transmitted information is to remote control satellites (Remember your test questions? Did you even take the test?).

I tend to belive that what you are wanting to do is incorrect, no matter how you justify it.

That being said, If you are transmitting the said information live, using either a control station ID, or your own ID, as part of an informational portion of an amateur network forum, then I would say that what you are doing is fine.

This is my take on the FCC regs, anyone else agree/disagree?

I completely agree with the previous post....

To routinely retransmit such transmissions a is illegal. IF your quote is 100% correct: "Propagation, weather forecasts, and manned spacecraft communications retransmissions may not be conducted on a regular basis, but only occasionally, as an incident of normal amateur radio communications."

It is clearly stated if you read it word for word adding absolutely nothing and deleteing absolutely nothing that "Regular Basis" transmissions of the type you propose are in fact not legal.

HOWEVER IF IF IF IF IF there is an emergency situation and you yourself are relaying storm and or storm situations then that would be leagal as the above reads because such is not on a "Regular Basis" but rather a unique emergency condition emergency condition.

Okay, They are not live, they are not pre-recorded either. They are messages that are received from a local private weather station and read using Microsoft TTS. The announcements of say meetings and such would be read in the same manner. I would of course use my callsign, which is in my profile on here. I signed up for this account before I received my license. I currently hold an Extra class license. So obviously I have taken the exams.

These messages are not "regular" they are only transmitted when there is an active alert which obviously isn't everyday of the year. The announcements, would be regular I suppose.

Like I said before, they aren't pre-recorded and they aren't live from another radio service such as NOAA weather radio. I'm using Weather Exchange from Ambient Weather to transmit these and they are read using Microsoft Text to Speech.

I should have specified this in the beginning, but I apologize for not having done so.

I appreciate your help to the new guy. (licensed for 15 months, so still very new and learning the ropes)

For me Ham radio is a life-learning process, you never stop learning. I will never know everything there is to know, so forgive me if you think this question and my interpretation of the rules give you the idea I haven't taken a test.

I forgot to mention that yes my quote is 100% correct. Look for yourself here: http://www.arrl.org/FandES/field/regulations/news/part97/ The first part is 97.111B and the second part was 97.113E.

Well, thank you for the help, but I spoke to a local ham and got his opinion and found out that what I wanted to do was illegal but there was a VERY easy workaround that IS legal.

This is the kind of question that if you ask the FCC they will be glad to tell you THEIR interpretation of the rules.
And that is what you really want to know!
