Hi guys,

if it is illegal for us to have a qso with a non licensed radio operator, is it also illegal for us to talk to a licensed ham radio operator using non-fcc certified radio equiptment?

Yes. Example: a ham can build his own equipment.

Not true. I can have a QSO with a non-licensed operator who is using someone else's station under the proper control of the control operator who would be licensed.

No. We can build our own equipment but it needs to conform to certain specifications as dictated by the FCC.

If the non-licensed operator is at a ham station under the direct control of a licensed ham (who must be present in the station), the answer is NO.

Under any other circumstances, other than a life or death call for assistance, the answer is YES.

hi,

we can build our own gear or use commercial
radios on the ham bands we are licensed for.

using a Micor radio on 6m or a qso with a
the pilot of a Boeing 777 using the hf radio on board.

ok. what about radios such as galaxy, rci, president, etc.... these are not certified by the fcc. if these are the radios being used by the other end, will it still be legal to have a qso with the operator?

Certified or not, to use any type of gear for a QSO with an unlicensed station in the ham bands is illegal... but then again, these days, what isn't? It's just as illegal for a ham to go out of band and jam another station, like the feeb from 2m I overheard jamming 156.800 a couple of weeks ago.

W3LK pointed out one exception, however... in a life or property threatening emergency, anything goes. Although here in the US, the authorities would probably find a way to punish someone for it.

The FCC does not require that radios be certified for use on the ham bands by licensed amateurs. The radios my not be certified for use on CB and thus illegal for use on CB. A licensed ham can legally use the same (or modified) radio on the ham bands. It is the ham's responsibility to ensure that the radio meets all Part 97 technical requirements however.

You will see FCC certification on VHF/UHF radios that have a scanning capability. That's a certification that is required of all scanning receivers in that frequency range.

If you are operating within the amateur bands, and both operators are using valid amateur call signs, how are you going to know what equipment the other operator is using?

well, how about when the operator announces what radio he is using??? and it so happens to be an hr2510.....
