Can't convince me of that.
The bar apparently is set on the ground. Judging from what I hear sometimes, it takes no mental competency whatsoever to key a microphone and even less to modulate it.

  LA is a perfect example of that.  The land of fruits and nuts.  Already got the FCC looking at him.   We offered the old man a CB radio and they didn't want him there either.   Time to whack his coax and put an end to it.

  It's a form of malicious(Mentally induced) interference  when you get to the point to where when you finish speaking you forget to unkey your mike then you need looking at.  When folks call you and say hey, unkey when you finish and you're duh, what, unkey, I don't recall being on?  You're lost as a ball in high weeds about what's happening.

BB brings up the most interesting point!  The owner/operator of the repeater has the responsibility of correcting this problem and if he doesn't he will have to answer to the FCC as well as the "nut."

If he's on a repeater, you (as trustee) have every right to exclude said gentleman from operation on the machine. Certified letter notifying the offender of the repeater owner's intentions first, CC the FCC Field Office.

Should that not fix the issue then you file a complaint.

ETA: The original post in this thread does not mention a repeater. If this is occurring on a simplex frequency you're simply S-O-L. Spin the dial.

  When the situation comes to this is K4XXXXX, Uh, 2 minutes later dead air  people  saying my  God,  Un-key already  next thing the repeater is timed down.

could it be children in his house are messing with a footswitch under his desk, or maybe playing with a handheld without him being aware of it? maybe a kid hears his dad on it and is trying to call him and dont know to unkey

if it is a case of missing marbles, a simple pl tone change should be a sufficient obstacle for him.
