This is the old adage of "Preaching to the Choir."  The people using those radios were not licensed.

They were all using their "Baofangs" to keep in touch.  I could hear a few of them on a 2 meter simplex frequency from my QTH.  Lots of "10-4s" and what's your "20?"

I saw a YouTube video somebody made using video from a news story and there were several Baofangs clipped on their tactical vests.

This is not publicity we need.

What is this world coming to? I have all this equipment and experience and I'm not allowed to use it when I do crimes! I need to sue the manufacturers for encouraging me in this endeavor, the ARRL too, and my first elmer, oh if only he knew what hardship he has led me into...

Saw in the paper a few days ago a mention that one of the militia's members were using "ham radios" to coordinate their "visit" to the Capital in DC a few months ago...

And I'll bet that none of them got the note from the FCC. If they only had their ham license....  ::)

Perhaps it's a warning to "preppers" and conspiracy theorists that The Man really is listening.

Also:

IANAL, but, since FCC regulates nongovernment radio, it is my understanding that if someone uses radio in the commission of a crime, they've also committed a Federal crime even if the original crime was purely a state crime that the Feds would otherwise have no jurisdiction over.

Or it could just be FCC getting some free publicity.

I mean....when was the last time:

- someone lost their Amateur Radio license for violating Part 97, or any other Part of FCC regs?

- someone actually paid a fine for violation of Part 97?

- someone actually was arrested, convicted and imprisoned for violation of Part 97?

And...how many years did it take?

There have been fines and settlements for violation of Part 97, and although they seem to be few and far between, the fines are still levied.  Granted it probably does take years and the fines are few.

Also, there are dozens of violations every single day, from the simple to the more serious.  Cursing, using the repeater bands to pass messages concerning commerce, 'broadcasting' where a non licensed individual monitors while a licensed one passes information, etc. and the simple reply of non-licensed individuals on the technically are violations.  The simple matter is that the FCC looks sideways at such useages and brushes them off.  Heck, remember when phone patch use was so mired in proper procedural use?

I did most of it aboard USN ships on MARS and 20M and on MARS from home. That basically bypassing/ignoring the FCC and giving the finger to Ma Bell did get a lot of intentional jammers BUT the FCC went and caught them instead for operating out of a ham band!

That was back when the FCC had the budgets and facilities all around the country to actually do any policing.
