Technician Cross Band Operation 75m - 2m

I would like to get some opinions on the following.  There is a Net which I regularly participate in on 75 meters (3.935) in the late afternoon / early evening.  There is another net 4 khz (3.931) down that overlaps our time slot for a portion of the time.  Normally there is no big issue, however sometimes there is a station that splatters up to 3.933-3.934.  Now I’m not gripping about the splatter, but questioning the following.

The net in question uses a 2-meter repeater to provide cross band access to their net. (It is the repeater that has the splatter problem.) We have checked some of the call signs using the repeater to check-in and they have Technician Class licenses.  So, the question is are the operators with Technician class licenses in violation?

This has been discussed by several of us and there are two points of view:

1) It’s in violation because Technician’s do not have voice privileges on 75 meters.

2) It’s not in violation because there must be a control operator at the point where the repeater is interfaced to the HF transceiver.

Is there a definitive answer? (I’m leaning to #2)

No violation because the operator with the technician license is transmitting on 2 meters.

Hello Dave,

The techs/novices are not breaking rules since they are using a frequency they are duly licensed to use.

The crossband point of HF could very well be a problem, if there "is no control operator" actively monitoring and controlling the HF transmitter.  I would hope that person would chime in at least every 10 minutes to properly ID.

Sounds like a really cool idea.  We have done "radio patches" like that in the past and enjoyed the experience.

Now, that splattering station should be contacted.  We don't make friends when we aren't minding our station emissions.
