My unincorporated amateur radio club in Tennessee has tasked me
With exploring how they can incorporate as a nonprofit entity
And how to obtain IRS 501(c)(3) status.

Incorporating as a nonprofit Corp in Tn is straight forward.
The difficulty is having the correct purpose and by-laws
that will be acceptable to the IRS and pass muster when
Filing IRS form 1023 ez, to obtain 501(c)(3) status. 

We are not interested in the 501(c)(7) status at all.

  Only 501(c)(3) status

My question to the forum is there any one that knows of any amateur radio club in any state that has been granted IRS 501(c)(3) status allowing any donations to the club to be tax deductible to the donor. 

If you do could you please share the club name with me and a contract email if you have one.

The Panama City Amateur Radio Club, Inc. a Florida not-for-profit corporation with Federal 501(c)(3) status.  We were incorporated in 1956 and had to completely re-do our By-Laws to comply with Federal Regulations concerning this status.  After you get thru with the State of Texas, then you can fill out the IRS forms, about 20 pages, and you must get every answer correct.  If you miss one, your application will be rejected, and they won't even tell you which one or ones are wrong.  Best thing to do is get a copy of one of the filings that did pass muster - I may be able to come up with our clubs as we only got rejected once.  You won't have to file 1023, just the "post card Form 990 - annually, unless your club takes in more than $25K monthly - takes our club many years to make that mark - HI.  Jim - K4LIX

As a CPA who does tax returns for several 501(c)3 organizations, be sure your articles of incorporation describe your organization's purpose as charitable, educational, scientific, philanthropy, amateur sports, prevention of animal cruelty, some kind of public good, etc.  IRS Publications 4220 and 557 explain what you need.

If your purpose doesn't fall into one of those areas, IRS will deny your application.

If it's rejected, you will also waste your application fee, which was over $600 the last time I checked on it for a club.  You pay that each time you apply.  You may also be looking at lawyer's fees to help draw up the paperwork.

It's not a cheap endeavor to become a 501(c)3 organization.

form 1023EZ and instructions are a half hour read; filing fee $400 last time I did one.

Sorry the fee is only $275 for 1023EZ.
