Texas Wireless and Antenna Bills

Texas House of Representatives is trying to pass two bill that would give individual counties the authority to regulate tower siting, antenna's and ANY wireless device. And Yes that does mean your Ham radio. The ARRL has drafted and submitted an amendment to the bill, but there has been no word on whether it will be included. The first bill is H.B. No. 1148 and the other is H.B. No 1492. 1148 is one bill that should aggressively opposed. The other bill would require lighting and marking of ALL antenna's/towers between 50 and 200 feet. Does the DBSTV industry know about this? If the satellite TV folks saw that anyone attempting to purchase & install one of their systems would need to apply 6 months in advance & hold hearings before they could install the antenna, they might get a little excited. But that is what it says. Receive-only satellite dishes are specifically mentioned. And even whip antennas, wonder if it will be save to drive through Texas with an antenna on the car?

Is the amended text available anywhere? All I could see was the submitted text.

I can't find any ammended test on the Texas site.  The HB1148 does seem to be on the move in an ammended (unknown) form.  Seems as though HB1492 is on the move also, hearings scheduled for April 17.

I looks like the H.B. 1148 will go into effect Sept. 1, 2001. Unknow if hams are exempt from this bill.

After looking this up on the recommended site I found that in the form finally passed it should not affect Amateur Radio. First the definition states ' for commercial use', we are not commercial. Second it exempts sites erected for emergency communications. By definition that includes the Amateur Radio Service.

The original bill would have been a "KILLER" to us.
