Hello.

First off, his last call was AA7DP.
And, second, in every case there was to be some sort of trade, not an actual sale.
He was in HIS location when the offers were tendered, not yours.
You can not argue theft, as this was to be an "Even Trade".
You have almost no legal recourse in this case under Washington state law.
And, no, this would have to be filed under Washington state law.
Where you are from or sent something from has no bearing on the case.
You chose to send your property to his location.
And, there is no set dollar amounts.
Under Washington state and Federal law, there was no actual theft
Now, the license he held were all cancelled in 2012.
In short, the guy knows the law and decided to screw a bunch of people.
Not one, not 2, not 3, but well over a dozen, and counting!

WOW! He is an attorney as well!

Hello.

Actually, I decided to look into this, ask a few questions.
The guy has not presented a valid call, and offered an "Even Trade", and a bad reputation.
And, several people filed theft cases, only to have them dismissed when it was discovered that this was to be "Even Trade".
If you agree to an "Even Trade" and it does not work out, there was no actual sale, and you are screwed!
Again, you can not argue theft in a "Even Trade".
In short, do not do it.

You are correct, it is not theft.

It is fraud. Also covered by both criminal and civil laws. And is usually an easier case to make. So you are not screwed at all. You just need to use the correct laws.

Better get your money back on your law degree.

Hello.

I looked up fraud under Washington state law, and Texas state law.
There has to be a clearly defined value, normally a dollar amount.
In the case of Orting WA, that was the answer I received.

You will note that whenever possible, I provide links?
And, to even imply I am an attorney when there is no evidence at hand to indicate so, is a criminal offense in all 50 states.

Then don't try to be an online lawyer. You stink at it.

And you are both arguing discussing a thread that's over 2 years old.  ;D  ;D

Sure...its been a slow day!  :D

And it is not arguing if you point out erroneous information. But some don't like it. Fine. Don't read it!

I use the mark read button on this forum a lot. If you use it on old threads, then you will have nothing to complain about. I think that's why they have it!

Hello.

I just saw how someone got screwed, and wanted to know the facts.
PRIOR to doing this trade, the guy had screwed several other people, changed his call, and screwed other people.
As he was already in trouble for theft, and fraud, he decided to switch tactics, and steal some more.
I wanted to fully understand this.
The guy stole left and right, was in jail for a while, changed tactics.
What I would like to know is what happened?
Did the short stint in jail teach him new tricks?
Why was he compelled to steal to begin with?
Does the change of calls have any bearing in this?
What was his occupation prior to stealing?
Thank you.

Don Pinson is now: NA0DP

Looks like the local paper has a write up on his email fraud with hams.

Pinson has changed his call about 3 times since this thread began.  He is now NA0DP.  Same address.

If his address is known, why not a nice knock on the door and a visit?

Anyone that's gullible enough to expect a "trade" to work out, not in person, is looking for heartache.

Are these Call Signs ALL the SAME guy, and are they THAT GUY,
OR is this a case of mistaken identity? Just wondered. Because I wouldn't want to make the error of mistaking someones identity. Wow! If that all IS the SAME GUY, that sure is a lot of Call Sign changes. They appear (to me) to be all listed under the SAME FR Number.

And IF this is soneone who has done wrong.. . IF he is the guy, or ANY guy for that matter if he would ever be convicted and has a record, isnt there some character clause to hold an FCC Licrnce? Just wondered...
Again, I don't want to contribute to making an error of mistaken identity because that would be a horrible thing to do.

Has he ever been actually convicted of a crime?  If not, while he may be a scumbag of the highest order, how could the FCC deny a license.

Pinson obviously views the ham hobby and hams as game to be trapped, snared, picked and plundered. He knows his victims are gullible and unable or unwilling to retaliate.

Either take a stance, initiate a case, make a difference, or stop whining.
